Summary: By downloading and using Quietude, you accept these terms. The app is intended for personal, non-commercial use.

1. Scope

These Terms of Service apply to the mobile application "Quietude" (hereinafter "App") and all related services. By downloading, installing, or using the App, you agree to these terms.

2. Service Description

Quietude is an iOS application for generating white noise and related soundscapes. The App offers:

Various noise types (White, Pink, Brown Noise, and more)
10-band equalizer for frequency adjustment
Spatial Audio with 3D positioning
Sleep timer and preset system
Background audio playback

3. License and Usage Rights

3.1 Grant of License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on your Apple devices in accordance with these terms and Apple Media Services Terms and Conditions.

3.2 Restrictions

You may not:

Copy, modify, decompile, or reverse-engineer the App
Use the App for commercial purposes without permission
Distribute, rent, or lend the App to third parties
Circumvent technical protection measures

4. Subscriptions and Payments

4.1 Free Trial

New users receive a 7-day free trial with full functionality. After expiration, your chosen subscription will be activated unless you cancel beforehand.

4.2 Subscription Options

Monthly: Automatic renewal every month
Yearly: Automatic renewal every year
Lifetime: One-time payment, unlimited access

4.3 Cancellation

Subscriptions can be cancelled at any time through iOS Settings. Cancellation takes effect at the end of the current billing period. No pro-rated refunds are provided.

4.4 Refunds

Refunds are processed in accordance with Apple App Store policies. For refund requests, please contact Apple directly.

5. Intellectual Property

All rights to the App, including trademarks, copyrights, patents, and trade secrets, remain with us. The App contains copyrighted materials that may not be used without our express permission.

6. Limitation of Liability

6.1 No Warranty

The App is provided "as is." We make no warranty for:

Uninterrupted or error-free operation
Fitness for a particular purpose
Therapeutic or medical effectiveness

6.2 Disclaimer

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid for the App in the last 12 months.

7. Health Notices

Important: Quietude is not a medical product and does not replace professional medical advice or treatment. For sleep disorders, tinnitus, or other health issues, please consult a physician.

Listen to audio at appropriate volume levels to avoid hearing damage. The app should not be used while driving or during activities requiring full attention.

8. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be announced through the App or via email. Continued use after changes constitutes acceptance.

9. Governing Law

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

10. Severability

If any provision of these Terms of Service is found to be invalid, the validity of the remaining provisions shall not be affected.
